2. Service Usage Guidelines
2.1 Platform Integrity Standards
Our platform is designed to support legitimate business communications while maintaining the highest standards of integrity and legal compliance. Users must operate within established guidelines to ensure system stability and protect all stakeholders in our communication ecosystem.
Prohibited Activities Include:
- Circumventing or attempting to bypass security measures or system limitations
- Engaging in activities that compromise network performance or availability
- Using services for purposes that violate intellectual property rights
- Deploying automated systems in ways that create excessive load or interference
- Misrepresenting identity, origin, or intent in communications
- Conducting activities classified as fraudulent, misleading, or harmful to recipients
- Account termination may occur without advance notice when usage patterns indicate violations of these standards or pose risks to platform integrity.
2.2 Legal Compliance Framework
All voice communications conducted through our platform must align with applicable telecommunications regulations and consumer protection statutes across relevant jurisdictions.
United States Regulatory Compliance: Your usage must comply with TCPA requirements, FCC regulations, FTC guidelines, TSR provisions, and National DNC Registry standards. State-level telemarketing statutes and wiretapping laws also apply to your communications.
International Regulatory Requirements:
- India: TRAI regulations, TCCCPR guidelines, and data protection mandates
- European Union: GDPR compliance, ePrivacy Directive adherence, and member state telemarketing laws

- Obtain explicit consent before using any individual's voice characteristics or vocal patterns for synthesis purposes

- Maintain clear documentation of voice data usage rights and limitations

2.5 Fraud Prevention and Identity Protection
Prohibited Fraudulent Activities: Users are strictly forbidden from deploying our platform for deceptive financial schemes, including but not limited to investment fraud, pyramid structures, advance fee scams, or any form of consumer deception.
Communication Authenticity Requirements: All communications must maintain transparent sender identification and accurate origin information. Deliberate misrepresentation of caller identity, organization affiliation, or communication source is expressly prohibited.
Voice Rights and Authorization Management: AI voice synthesis may only utilize vocal characteristics for which you possess explicit legal authorization. Unauthorized replication of individual voice patterns, celebrity likenesses, or recognizable vocal signatures is strictly forbidden.
Consent Documentation and Verification: When consumer authorization is legally mandated, users must establish robust consent collection systems and preserve verification records for no fewer than five years or the minimum statutory requirement, whichever extends longer.
Registry Maintenance and Call Screening: Outbound AI voice campaigns require systematic validation against relevant Do-Not-Call registries with refresh cycles not exceeding 31 days.
3. Billing and Subscription Management
3.1 Service Plans and Pricing: Current subscription plans and pricing are available at www.superdash.ai/pricing. All services operate on a recurring monthly subscription model.
3.2 Payment Authorization and Processing: By subscribing to our services, you provide valid payment method details and grant us permission to automatically charge the associated account for all fees, including monthly subscriptions, overage charges, and applicable taxes.
3.3 Subscription Modifications and Cancellation: Account cancellation requires removal of all active voice agents and phone number assignments prior to your next billing date. Plan upgrades take effect immediately, while downgrades become active at your next renewal date.
3.4 Payment Method Maintenance: You must ensure your payment information remains current and valid. Account holders are responsible for all fees resulting from declined payments.
3.5 Invoicing Options: Standard billing occurs automatically through your registered payment method. Custom invoicing arrangements may be available for enterprise accounts.
3.6 Payment Failures and Account Status: Failed automatic payments trigger email notification with a 14-day payment window. Accounts with outstanding balances receive an additional 7-day courtesy period before service suspension. Unpaid balances may incur late fees up to 10% of the overdue amount or the maximum permitted by applicable law, whichever is lower.
3.7 Rate Adjustments: We reserve the right to modify subscription rates and overage pricing with advance notice via email and website updates. New pricing takes effect with your subsequent billing cycle.
4. User Responsibility and Risk Allocation
4.1 Defense and Indemnification: You agree to indemnify, defend, and hold harmless Superdash, including its officers, employees, representatives, and affiliated service providers, from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or related to: (a) your use of or inability to use the Site or Services; (b) any content or postings submitted by you; (c) your violation of this Agreement; (d) your infringement of any third-party rights; or (e) your violation of applicable laws, rules, or regulations.
Superdash reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Our platform and all associated offerings are delivered on an "as-is" basis without representations or guarantees of any nature. We explicitly disclaim all warranties, whether stated or implied, including those related to merchantability, suitability for specific uses, and compliance with applicable regulations.
6. Damages and Liability Restrictions
Subject to maximum legal allowances, we shall not bear responsibility for indirect, secondary, punitive, or consequential harm of any form. Our maximum financial responsibility under any circumstances is limited to the higher of: (1) fees paid by you for the specific service related to your claim during the preceding twelve months, or (2) one hundred dollars ($100 USD).
7. Data Processing and Voice Analytics
When you utilize our AI voice orchestration platform without opting out of data collection, you authorize Superdash to capture and analyze voice interactions, conversation data, and related communication materials ("Voice Data") for the purpose of enhancing AI-driven insights and advancing our artificial intelligence capabilities. All Voice Data undergoes anonymization and aggregation processes using industry-standard privacy protection methods before utilization in service improvement.
8. Platform Rights and Ownership
8.1 Superdash retains complete ownership and control over our AI voice orchestration platform, including all proprietary technology, algorithms, user interfaces, brand elements, and associated intellectual property, except for content you create ("User-Generated Materials").
8.2 Upon your adherence to these terms, Superdash provides you with a limited, non-transferable, revocable authorization to access our platform for your business operations.
8.3 You maintain ownership of all original content, data, configurations, and materials you input into our platform ("User Materials"). By utilizing our services, you grant Superdash a global, royalty-free license to process, analyze, and utilize your User Materials solely for service delivery and platform improvement purposes.
8.4 Superdash retains ownership of the underlying AI models and voice synthesis technologies. You receive usage rights to AI Outputs created through your legitimate use of our platform.
8.5 Any suggestions, recommendations, or improvement ideas you provide regarding our platform ("Platform Feedback") become part of Superdash's development resources.
8.6 Our platform may incorporate external technologies and services. Superdash does not claim ownership of third-party components.
9. Brand Usage and Marketing Rights
All brand names, logos, and distinctive marks associated with our platform belong to their respective owners. You may not utilize any Superdash branding without explicit written permission.
You authorize Superdash to identify you as a platform user in our marketing materials and case studies.
10. Content Protection and Copyright Compliance
Superdash respects intellectual property rights and expects platform users to maintain similar standards. We respond promptly to legitimate copyright infringement claims that comply with applicable laws.
To report suspected copyright violations, please provide our legal team with:
- Authorized signature from the copyright holder or their representative
- Clear identification of the copyrighted material in question
- Specific location of the allegedly infringing content within our platform
- Your complete contact information including address and phone number
- A sworn statement regarding your good faith belief that the use is unauthorized

13.1 While we strive to maintain high availability and performance standards, our AI voice orchestration platform operates subject to various technical and external factors.
13.2 You are responsible for ensuring your systems and infrastructure are compatible with our platform requirements.
14. Dispute Resolution and Jurisdiction
14.1 All disputes must first be addressed through direct negotiation. You must provide written notice of any claims to our legal department. We commit to good faith negotiations for a period of 60 days before formal legal proceedings may commence.
14.2 Both parties agree that any legal proceedings will be conducted on an individual basis only, not as class actions or representative suits.
14.3 This agreement is governed by Indian law and regulations. All legal disputes fall under the exclusive jurisdiction of courts in Kochi, Kerala, India.

15. Agreement Modifications and Force Majeure
15.1 You may not transfer or assign this agreement without prior written consent from Superdash.
15.2 Neither party bears responsibility for performance delays or failures caused by circumstances beyond reasonable control, including natural disasters, governmental actions, technical infrastructure failures, pandemics, civil unrest, or other force majeure events.
16. Contract Integrity and Support
16.1 If any provision of these terms is deemed invalid or unenforceable, it will be modified to the minimum extent necessary while preserving the validity and enforceability of all other provisions.
